Limited Warranty.

	a.	 Warranty Period and Scope.  Products purchased after February 15, 2017 are eligible for the 5-Year Warranty. For a period of five (5) years from the date FLO-CORP ships the Product(s) to Purchaser or the Delivery Location, FLO-CORP warrants solely to Purchaser that in the event the Product(s) experience any major defects in materials or manufacturing that render the Product(s) unusable, then FLO-CORP will repair or replace the Product(s), at FLO-CORP's sole option (the “Warranty”). This is the only warranty provided by FLO-CORP for the Product(s).  Notwithstanding the foregoing in this Paragraph, the Warranty only applies to those components of the Product(s) that are non-moving. To assure FLO-CORP’s 5-year warranty service, online warranty registration is required for all FLO-CORP Product(s), found at www.flo-corp.com. Products must be registered within 90 days from time of shipment. 
	b.	Limitation of Warranty; Warranty Disclaimer.  The Warranty is the exclusive warranty for Product(s). FLO-CORP MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE. The Warranty does not extend to or cover, and FLO-CORP is not responsible nor makes any warranty as to:  (i) the use of Product(s) under abnormal conditions; (ii) an intended use or conditions that exceed the performance specifications or performance parameters of Product(s); (iii) use of Product(s) under conditions not reasonably foreseeable to, or beyond the control of, FLO-CORP; (iv) the suitability of Product(s) for Purchaser’s intended use; (v) normal wear from product usage or age; (vi) improper storage, handling, installation, finishing, use, operation, modification, repair or maintenance of Product(s); (vii) mechanical abrasion to finishes; (viii) non-factory-applied components to Product(s) or application of aftermarket items to Product(s); (ix) failure to install Product(s) pursuant to any instructions furnished or published by FLO-CORP and any damage resulting therefrom; (x) normal wear or discoloration of finish from product usage or age; (xi) acts of God or force majeure; (xi) accident to and alterations to, and misuse, abuse (abuse shall be assumed when indicated by electrical damage to relays, reed switches or other components), improper handling, operation or cleaning of, Product(s), including, without limitation, electrical or chemical damage to the Product(s) due to accident, misuse, abuse, alterations, improper handling, operation, or cleaning; (xii) Product(s) subjected to conditions outside their design limitations, performance specifications or performance parameters; (xiii) Product(s) that have not been paid in full by Purchaser; (xiv) altered or reinstalled Product(s); and (xv) negligent storage, installation, operation, use and maintenance of the Product(s).
	c.	Limitation of Liability. THE WARRANTY SETS FORTH THE MAXIMUM LIABILITY FOR PRODUCT(S). IN NO EVENT SHALL FLO-CORP. BE LIABLE TO PURCHASER FOR ANY PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, COVER, INDIRECT OR OTHER SIMILAR DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, LOST OPPORTUNITIES, LOST SAVINGS, LOST USE OF PRODUCT(S), INEFFICIENCY CLAIMS OR DAMAGES FOR DELAY) RESULTING FROM THE PURCHASE, SALE, INSTALLATION, OPERATION OR USE OF PRODUCT(S).
	d.	Limitation of Remedy. THE EXCLUSIVE REMEDY OF PURCHASER, AND THE SOLE LIABILITY OF FLO-CORP, UNDER THE WARRANTY FOR ANY AND ALL CLAIMS, CAUSES OF ACTION, LOSSES, INJURIES OR DAMAGES (INCLUDING, WITHOUT LIMITATION, CLAIMS OR CAUSES OF ACTION BASED UPON BREACH OF WARRANTY, BREACH OF CONTRACT, INDEMNITY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, ANY OTHER TORT, OR OTHERWISE) ARISING OUT OF, OR RELATED TO, A SALES ORDER CONTRACT, THESE GENERAL CONDITIONS, THE WARRANTY, THE PURCHASE, SALE, INSTALLATION, OPERATION OR USE OF PRODUCT(S), AND THE PRODUCTS, SHALL BE, AT THE SOLE OPTION OF FLO-CORP, THE REPAIR OR REPLACEMENT OF THE PRODUCT(S), AS PROVIDED IN THIS SECTION.
	e.	Replacement Products.  Replacement product(s) provided pursuant to the Warranty may be a reasonably similar current product and may not exactly match the Product(s) originally purchased under the Sales Order Contract. Replacement product(s) provided pursuant to the Warranty shall be subject to the Warranty only for the remainder of the original warranty period on the Product(s) replaced. If FLO-CORP provides any of the remedies identified in this Section (i.e., repair or replacement of the Product(s)), then Purchaser agrees that this limitation of remedy shall not have failed of its essential purpose.
        f.	No Statement of Useful Life. The Warranty is not a statement of the useful life of Product(s).
        g.	Notice of Claim. Within the applicable warranty period set forth, Purchaser shall immediately notify FLO-CORP in writing of any defect or other basis of claim covered by the Warranty is discovered or should have been discovered, but in no event more than six (6) months after any such defect or other basis of claim covered by the Warranty is discovered or should have been discovered.  Such notice of claim shall be accompanied with proof of the date of purchase.  Any claims otherwise covered by the Warranty, but which FLO-CORP did not receive notice within six (6) months from the time the defect or other basis of claim covered by the Warranty first became known or should have become known, shall be forever barred, waived and released.  Claims under the Warranty shall be made in writing to FLO-CORP at FLO-CORP’s Address set forth in the Sales Order Contract in accordance with Section 12 of FLO-CORP’s General Conditions.  Such notice shall be a condition precedent to FLO-CORP having any obligation under the Warranty, and until a claim under the Warranty is made in accordance with this Paragraph (g) and Section 12, no such claim under the Warranty shall be effective or otherwise deemed made.
        h.	Inspection by FLO-CORP  PURCHASER SHALL NOT REPAIR, REPLACE, REMOVE, ALTER OR DISTURB ANY PRODUCT(S), NOR SHALL ANY THIRD-PARTY REPAIR, REPLACE, REMOVE, ALTER OR DISTURB ANY PRODUCT(S) PRIOR TO INSPECTION BY FLO-CORP. OF THE ALLEGED DEFICIENT OR DEFECTIVE PRODUCT(S) OR UNLESS OTHERWISE INDICATED IN WRITING BY FLO-CORP; HOWEVER, PURCHASER MAY TAKE EMERGENCY ACTION NECESSARY TO PREVENT DAMAGE TO PERSONS OR PROPERTY. FAILURE TO STRICTLY COMPLY WITH THIS PARAGRAPH (h) SHALL VOID THE WARRANTY.
        i.	No Relationship with Any Third Party Created.  In no event shall the Warranty create any relationship with a third party or provide warranty rights to a third party, including neither the creation of a third party beneficiary or creditor beneficiary, nor the creation of any similar rights to a third party.

*The warranty period for moving parts of the FLO-CORP PDFlo PDSG1 Spur Gear Flow Meter and MAGFlo spool piece/flow tube is 1 year. Repaired or replaced products are warrantied to the remainder of the original product’s warranty period, or 90 days from the replacement, whichever is longer.
